ColoradoBiz magazine has featured an article by BAM shareholder Margot Alicks.

“Who Gets the Dog in a Colorado Divorce” acknowledges the strong likelihood that millennials and younger Americans will be pet owners.  In light of this, Margot explains that pets are considered personal property under Colorado law and are thus not subject to custody arrangements as children would be.  The takeaway is: Only one person gets the dog.

Margot explains that because animals are considered personal property under Colorado law, if families want more flexibility in how the animals are handled, this is an area ripe for settlement rather than litigation.  She also lays out some factors a court might consider in dividing pets as qualified personal property.
