Dissolution of Civil Union
Colorado’s Uniform Dissolution of Marriage Act (UDMA) has been amended to include the dissolution of civil unions. It helps maintain the technical difference between a marriage and a civil union while still providing for uniformity and equity in the treatment of separating couples. The caption in a case like this will say “In re: the Civil Union of…”, rather than “In re: the Marriage of….” C.R.S. 14-10-105. Aside from the different captions on the pleadings filed, the procedural and essential requirements for dissolving a civil union are identical to those required in the dissolution of a marriage. C.R.S. 14-10-106.5. Assets, debts, parenting time, support, maintenance, and the other ancillary issues are handled in the same manner. Many courts will require mediation before the dissolution of a civil union just as they do for marriages.
